Court Grants Atiku, Obi Approval To Inspect Election Materials

Atiku Abubakar, of the Peoples Democratic Party, and Peter Obi, of the Labour Party, were granted access to the election materials used in the presidential election last Saturday by the Court of Appeal in Abuja on Friday.

Fidel Info reports that The Presidential Election Court was contacted by Atiku and Obi to request authorization for the inspection of the voting equipment used on last Saturday.

After the presidential election on February 25, Atiku and Obi refused to accept loss and vowed to enforce their victory in court.

The court on Friday granted access to all the sensitive materials INEC used for the presidential election won by Bola Tinubu, the candidate for the All Progressives Congress.

After hearing two distinct ex-parte applications submitted by Atiku, Obi, and their political parties, the appellate court panel, which will also serve as the Presidential Election Petition Tribunal, granted the request. The panel was led by Justice Joseph Ikyegh.

Tinubu, the APC, and the electoral umpire were listed as respondents in the case.

Both applications were predicated on Section146 (1) of the Electoral Act 2022, Paragraph 47 (1, 2 &3) of the First Schedule of the Electoral Act of 2022, as well as under the inherent jurisdiction of the Court as referenced by Section 6 (6) A & B of the 1999 Constitution, as amended.

Obi, in his application that was moved by his team of lawyers led by Mr Alex Ejesieme, SAN, sought six principal reliefs.

Atiku’s lawyer, Adedamola Faloku, sought seven prayers from the tribunal.

Specifically, the applicants urged the court to compel INEC to allow them to obtain documents in its custody that were used for the presidential election.

They maintained that the requested documents would aid their petition against the outcome of the presidential contest that was declared in favour of Tinubu.

The Independent National Electoral Commission (INEC) has declared the Adamawa State governorship election as inconclusive.

Fidel Info reports that INEC state collation officer, Prof Muhammadu Mele of the University of Maiduguri, said he made the decision due to the margin of votes.

“Elections were not held in 47 wards, affecting 69 polling units. So, this gives us a margin of 31,249 [between the leading candidates]. The total number of PVCs collected in places where elections were not held amounted to 37,016,” he said.

Mele said “based on these findings and analysis as stated in the electoral laws” where the margin between two candidates is lesser than the total number of collected PVCs in areas where elections were not held, the election is declared inconclusive.

The All Progressives Congress (APC) and the Peoples Democratic Party (PDP), whose candidates are the major contenders in the election, have been trading blames.

Fintiri of PDP scored a total of 421,522 votes, while Binani of APC scored 390,275 votes from the 21 local governments.

The Independent National Electoral Commission (INEC) has declared the candidate of the All Progressives Congress (APC), Senator Uba Sani, the winner of the 2023 governorship election in Kaduna State.

Fidel Info reports that The Returning Officer for the election and Vice Chancellor of the Usman Dan Fodio University, Sokoto, Professor Lawal Suleiman Bilbis, made the declaration on Monday night.

Sani polled a total of 730,002 votes to defeat his closest rival, Isa Ashiru of the Peoples Democratic Party (PDP) who polled 719,196 votes.

The Labour Party (LP) candidate, Jonathan Asake came a distant third after polling 58,283 votes while the New Nigeria Peoples Party (NNPP) candidate, Suleiman Hunkuyi scored 21,405 votes.

Sani is a sitting Senator and an ally of the incumbent Governor, Nasir El-Rufai.
